Abstract: This study will highlight how the current international framework for outer space falls short of addressing the issues that are of concern for private actors. It will take the three main factors that affect business encouragement, which are: freedom of action, business risk assessment, and competition, and will analyze the provisions of the treaties which influence them. The study will conclude that private actors have excessive freedom due to underwhelming international regulation and monitoring, which already creates legal uncertainty and will primarily affect competition dynamics in the industry.
